Welcome to the Gypsy and Jazz online school. The following Terms of Use apply whenever you access Gypsy and Jazz or any other site owned or operated Yaakov Hoter in the present or past or that may be owned or operated thereby in the future, on any device, including social media sites and YouTube channels. Please peruse this document in full. When you use the online school you are expressly agreeing to the terms disclosed herein. In case these Terms of Use are not acceptable to you, you have no right to view or make use of the Gypsy and Jazz online school or any site owned or operated Yaakov Hoter (hereafter, collectively – Gypsy and Jazz) in any way.
Unaffiliated sites that Gypsy and Jazz may link to or direct you to are not covered by these terms of use.
I retain the right to modify these terms at my own discretion, so please review them from time to time. When you use Gypsy and Jazz, you agree to accept any changes to these terms, regardless of whether you have actually read them or been told of them. If you decide that these terms of use are not acceptable to you, please refrain from use of Gypsy and Jazz.

All the materials on Gypsy and Jazz are designated for your personal use. A strict prohibition applies to any modification, deletion, display, change, adaptation, transmission, exploitation, or copying for distribution or sale of any material, information, trademark, or copyright on Gypsy and Jazz. Publication, distribution, display, or commercial exploitation of any material from Gypsy and Jazz without express advance written position is forbidden. By using Gypsy and Jazz, you agree to abide by all copyright notices or other posted restrictions.

Submissions
Your comments and questions about Gypsy and Jazz are important to me. I am committed to maintaining a close relationship with my students, answering their questions and meeting their needs. However, to avoid the possibility of future misunderstandings in the event that ideas developed by me or on my behalf might seem to be similar to the ideas submitted to us please refrain from submitting unsolicited creative ideas or materials. All unsolicited submissions shall become my property and I will not be subject to any obligation to you in respect thereof. I will exclusively own all rights to the said submission and be entitled to the unrestricted use thereof for any purpose, without compensation or notification to the person or people who sent the material. Therefore, I wish to emphasize that you should not submit creative projects to us, especially if they are confidential or personal.
Forums
The term “forum” refers to message boards, comments, chats or other means of interacting with students on Gypsy and Jazz, whether public or private. Registration as specified on Gypsy and Jazz is required for participation in any forum. Forbidden posts include any material that is abusive, vulgar, threatening, harassing, libelous, defamatory, obscene, invades a person’s privacy, violates any intellectual or other property rights, or that would otherwise violate any law. Soliciting funds, and advertising or soliciting goods or services are strictly prohibited. You may only post material you believe to be true. No messages relating to stock transactions are permitted. Transmissions containing a virus or other harmful component are strictly forbidden. I assume no responsibility for material appearing in any forum on Gypsy and Jazz, except for material signed by me of someone expressly appointed by me as my representative. We do not undertake to screen material posted by users in any way, including checking for such forbidden postings as those containing libel, obscenity, invasion of privacy, copyright or trademark infringement, inaccuracy, et al. I do, however, retain the right to change, edit or delete messages or other material that I find to be objectionable, irrelevant, or unacceptable for any reason whatsoever and to edit materials posted at my own discretion. In any case, users retain sole responsibility for the content of their own postings. By posting on Gypsy and Jazz, you grant (or guarantee that the owner of such rights has expressly granted) Gypsy and Jazz and Yaakov Hoter, nonexclusive right to use anything you post on Gypsy and Jazz forums, as submitted or in edited form, in any medium now known or later developed. Registration may be suspended or terminated in case of any inappropriate use of Gypsy and Jazz.

I do not guarantee the effectiveness of the ideas or success strategies of Gypsy and Jazz, except for any guarantees of satisfaction expressly stipulated as such. There is no warrantee that Gypsy and Jazz will always operate in a manner that is uninterrupted or error-free, that defects will be repaired, or that Gypsy and Jazz or the server that makes it available are free of viruses or other harmful components. I do not guarantee the use or the results of the use of the contents of Gypsy and Jazz in any way. Only you (not I or any related service-provider) assume the entire cost of all necessary servicing, repair or correction to your system. The aforesaid is contingent upon its compliance with any applicable law. I do not warrant, guarantee or endorse any third-party products or services offered on Gypsy and Jazz or accessed via link therefrom. I will under no condition be held responsible or liable, directly or indirectly, for any actual or alleged damage or loss you may experience in connection with your use of any advice, goods or services you receive from a guest teacher on Gypsy and Jazz or at a related event.
I am not liable or responsible for any loss or damage caused or alleged to have been caused to our guest teachers in connection with the display of their photo, name, or biography posted on Gypsy and Jazz or in our marketing materials.
No Professional Advice
You alone are responsible and accountable for your decisions, actions and results in life, and by your use of Gypsy and Jazz, you agree not to attempt to hold us liable for any such decisions, actions or results, at any time, under any circumstance.
REFUND POLICY
As stipulated by law, I cannot and do not make any guarantees about your ability to get results or earn any money with our ideas, information, tools or strategies. What I do guarantee is your satisfaction; you have a 30-day 100% satisfaction guarantee, so if you are not happy for any reason with the quality of our training, just ask for your money back. All products and services of Gypsy and Jazz are solely for educational and informational purposes. None of the content or curriculum is a guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice. You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.
Parental Permission
Gypsy and Jazz is not directed to children under the age of 13 and the site does not knowingly collect information from children under 13. Parental control to limit the areas of the internet to which their children have access is highly recommended. Users under 18 may be required to obtain the consent of a parent or guardian to participate in Gypsy and Jazz courses. You agree to abide by any such restrictions, and not to help anyone avoid these restrictions.
Confidentiality and Non-Competition
All content of Gypsy and Jazz is proprietary and protected by copyright. In using the service, Users agree to refrain from recording, duplicating, distributing, teaching or training using the methods and materials on Gypsy and Jazz in any manner whatsoever without our express written permission. Any unauthorized use of Gypsy and Jazz materials, proprietary concepts, and intellectual property by you or your representatives is prohibited and legal action will be taken and full damages demanded in case of violation of these terms.
Jurisdiction
These terms will be governed by and construed in accordance with the laws of the State of Israel, without regard to any principles of conflicts of law. You hereby consent to binding arbitration in the State of Israel to resolve any disputes arising under these Terms and Conditions. If any of these terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions. These terms may be modified only by our posting of changes to these terms of use on Gypsy and Jazz.
